to federal citizenship, there is also citizenship of subjects. And in Switzerland, in
addition to federal citizenship, there are citizenships of the canton and the community”
[1].
Throughout history, the legal regulation of citizenship has been exclusively an
internal affair of the state. Today, domestic law plays a major role in this. By virtue of
its supremacy, the state establishes the rights of a citizen, the procedure for acquiring
and losing citizenship.
In our time, the role of international law in determining the rights of a citizen is
growing. This applies, first of all, to the norms on human rights and on the jurisdiction
of states. The revolutionary step was taken thanks to the adoption of the Universal
Declaration of Human Rights in 1948, which proclaimed "the right of every person to
a citizenship" [4].
Issues of citizenship in the Republic of Kazakhstan, as in other countries, are
regulated by national legislation and are consistent with international standards. The
fundamental law of the Republic of Kazakhstan - the Constitution - fixes the basic
principles of the institution of citizenship, describes the rights and freedoms of citizens
of the Republic of Kazakhstan (Articles 10-11) [5]. Issues of citizenship in accordance
with paragraph 14 of Article 44 of the Constitution of the Republic of Kazakhstan are
decided by the President of the Republic of Kazakhstan[5].
Also, in accordance with Article 10 of the Constitution of the Republic of
Kazakhstan, “A citizen of the Republic cannot be deprived of citizenship, the right to
change his citizenship, and also cannot be expelled from Kazakhstan. Deprivation of
citizenship is allowed only by a court decision for committing terrorist crimes, as well
as for causing other grave harm to the vital interests of the Republic of Kazakhstan”
[5]. According to the Constitution, “Citizenship of the Republic of Kazakhstan is
acquired and terminated in accordance with the law, is single and equal, regardless of
the grounds for its acquisition. Citizenship of another state is not recognized for a
citizen of the Republic” [5].
